LAST WILL AND TESTAMENT OF 


DENNIS F. STEVENS (2020) 



I, DENNIS FRANK STEVENS (sometimes hereinafter “Stevens”), and hereafter referred to in both the first and second person, a resident of Rexburg, Idaho, born 22 March 1939, being of sound and disposing mind and memory and a married man, albeit legally separated, and not being actuated by any duress, menace, fraud, mistake, or undue influence, do make, publish, and declare this to be my last Will and Testament, hereby expressly revoking all Wills and Codicils previously made by me.   


I. MARRIAGE AND CHILDREN:   


I am married to, but since 5 May 2005 contractually separated from, MELBA ROLLAN STEVENS.  I have the following children:  


TORE DONALD STEVENS (“Tore”), born 24 February 1965, whose mother’s maiden name is GAIL FOSSAGE;


MELBI LEE STEVENS (“Melbi”), born 20 July 1979, whose mother is MELBA R. STEVENS;  


ERIN LEIGH STEVENS, born 30 May 1985, whose mother’s maiden name is GAYLE VERNON.  


2. EXECUTOR:  


2.1    I appoint my sister CHARLOTTE RIVIERA as executor of this my Last Will and Testament (“Executor”) and, provided if Executor is unable or unwilling to serve, then I appoint my cousin VICKI LEE GROVER, currently residing in the township of Hibbard, Idaho, a suburb of Rexburg.  Cell: (208) 351-7044.  


2.2    In the event of Vicki Grover’s incapacity or refusal to perform, I hereby appoint Vicki’s husband WAYNE GROVER.    


2.3    In the event neither Charlotte, Vicki, or Wayne are available, then I appoint my able daughter Melbi.  


2.4    Charlotte’s current address is:  10042 Main Street, Apartment 302, Bellevue, WA 98004-6046.   Cell (206) 914-2600.  


2.5 My Executor shall be authorized to carry out all provisions of this Will and pay my just debts, obligations and funeral expenses.

2.6 My Executor shall serve without any bond, and I hereby waive the necessity of preparing or filing any inventory, accounting, appraisal, reporting, approvals or final appraisement of my estate.  I direct that no expert appraisal be made of my estate unless required by law.  


2.7 My Executor shall be entitled to reasonable compensation for the duties performed with respect to carrying out my final wishes and the duties required by law.  


3. BACKGROUND ON THE REAL PROPERTY ASSETS OF DENNIS F. STEVENS: 


3.1 At the time of the filing of this Will, I have no real estate assets or holdings.    


4. OTHER ASSETS.   THE CROSS-UP MINI TV SERIES SCREENPLAYS:    


4.1 The biggest potential asset by far is the 12-episode short form TV series scripts known as the Cross-up Series (hereafter “Cross-up Series”).  Although the name Cinema Arts LLC may from time to time come into play, the said company or entity (should it still exist) has no ownership or financial interest in this Series.   


4.2 Ownership in the Series belongs to the copyright holders to certain episodes in the Series; namely Dennis F. Stevens (“DENNIS”); Melbi Lee Stevens (“MELBI”); and Christine R. Graham (“GRAHAM”).  A list of the episodes and the copyright holder is as follows:

5.1 The second biggest potential asset is the 5–episode short form TV series scripts known as the Brigand series (hereafter “Brigand Series”).  Although the name cinema Arts Productions, Inc, and Cinema Arts LLC may from time to time come into play, the said companies or entities (should theyt still exist) have no ownership or financial interest in this or any other series.  


5.2 Ownership in the Series belongs to the copyright holders to certain episodes in the Series; namely STEVENS, MELBI, and GRAHAM.  A list of the episodes and the copyright holder(s) is as follows:

6.1 The third biggest potential asset is the 4 – episode short form TV series scripts known as the Mossad Diaries series (hereafter “Mossad Diaries Series”)  Although the name Cinema Arts LLC may from time to time come into play, the said company or entity (should it still exist) has no ownership or financial interest in this Series.   


6.2 Ownership in the Series belongs to the copyright holders to certain episodes in the Series; namely STEVENS, MELBI, and GRAHAM.  At this time all four of the episodes are copyrighted in the name of Christine R. Graham.

executed over time.  The said agreement(s) will spell out the sums of money both the copyright holders and the writers will receive as part of any airing or sale of the series.  


8. INVENTORY AND BACKGROUND ON OTHER LITERARY MATERIAL WHETHER ORIGINAL, REMAKE OR SEQUEL RIGHTS; WHICH RIGHTS ARE OWNED BY STEVENS:    


8.1 Dennis F. Stevens, an individual, as successor to the literary and other rights previously owned by Cinema Arts Productions, Inc., a Washington State corporation, previously qualified in California, now owns the rights to the following literary and motion picture properties, not necessarily listed hereunder in the order of their creation:  


8.1 (a)   The remake and sequel rights to the feature films “Harrad Experiment” (1973) and “Harrad Summer” (1974); based upon the novel and characters created by Robert H. Rimmer; which rights are subject to the terms and conditions originally set forth in those certain Rights Purchase Agreements executed between original rights holder, Sherbourne Press, and Cinema Arts and later modified by an agreement between Stevens and Rimmer’s son Steven King Rimmer, who inherited the films underlying rights from his father; who owned the said rights at the time of his death.      


8.1 (b)   The remake and sequel rights to “I Wonder Who’s Killing Her Now?” (1975), based on an original screenplay by Mickey Rose; the said rights of which are owned outright by Stevens.  


8.1 (c)   The motion picture and ancillary rights to the literary works:  “Stand By-y-y to Start Engines,” and “Now, Hear This!” by Daniel V. Gallery (the “Gallery Works”); together with various draft screenplays based in part on the “Gallery Works”; which rights are subject to terms of that certain literary purchase agreement executed in 1975 between Daniel V. Gallery and Cinema Arts.  


8.1 (d)   A few of the character’s names depicted in Episode 2 of the Cross-up Series are based on those found in the Gallery short stories although no plot points from any of the Gallery books are found in the said script.   


8.2 The Ad Lib and Rocky Road TV Shows.

8.2 (a)     “The Ad Lib Show” consisting of twenty-six half-hour episodes, was produced in 1981 and 1982.  A series description is available online from the Internet Movie Database (IMDb). “The Ad Lib Show” first aired on Robert Johnson’s Black Entertainment Television (BET).  


8.2 (b)    “The Rocky Road Show,” consisting of fifty-six half-hour episodes was produced in 1981 and 1982 featuring such musical groups as Romeo Void, Missing Persons, Tower of Power, The Busboys, Roach & the White Boys, and many, many more popular rock groups of the era.  These tax-shelter financed shows aired once on the Armed Forces Radio & Television Services (AFRTS) in 1982.   


8.2 (c)   As an aside, the Internet Movie Database (“IMDb”) refused to list “The Rocky Road” show in its database because at the time they did not consider product made exclusively for AFRTS to qualify; although the shows aired in 12 countries and were viewed by far, far, more individuals than ever saw “Ad Lib.”    


8.2 (d)    A distribution agreement currently exists between Ian 

Marshall and Bill Dicicco of Retro Video, Inc. (1435 Gardena Ave., Suite 12, Glendale, CA 91204 – email: info@retrovideo .com) and Dennis F. Stevens for distribution of the “Ad Lib” and Rocky Road” shows.  In exchange for storing the elements for the two shows, Retro Video has the right of distribution; which rights can be cancelled at any time.  


8.2 (e)   The Ad Lib and Rocky Road shows are owned exclusively by Stevens who hereby in this last will and testament leaves to Melbi Lee Stevens including all his rights and interest therein.   


9. REVERSION OF CERTAIN RIGHTS FROM CINEMA ARTS PRODUCTIONS INC.  TO DENNIS F. STEVENS:  


9.1 In a document executed in 1976 for the purpose of obtaining a life insurance policy from Pacific Life for the purpose of reimbursing the debtors of “I Wonder Who’s Killing Her Now?” in the event that Dennis F. Stevens became deceased or disabled before personally repaying the $300,000 indebtedness owed to the film’s creditors (by the film’s completion guarantor), Stevens executed an agreement on behalf of Cinema Arts; which agreement was ratified by Cinema Arts minority shareholders, Frank W. Stevens and Charles J. Guntley,

stating that should Cinema Arts cease to be qualified in the State of California, through failure to pay state corporate fees, or otherwise, all rights and liabilities in and to the projects owned by Cinema Arts would automatically revert to Stevens.  Such an event did occur in the 1990s and ownership of the properties reverted to Stevens.  


10. SCREENPLAYS:  EAGLE IN THE SKY and GUNFIRE REEF:  


10.1 Under an option agreement Stevens wrote two screenplays based on novels by Wilbur Smith, “Eagle in the Sky” and “Gunfire Reef,” the latter based on Smith’s novel “Eye of the Tiger” (hereinafter “the Wilbur Smith Projects”).   Neither script can be produced without purchasing the said underlying rights. Nevertheless, with such purchase, both scripts have intrinsic values estimated to be not less than the Writers Guild Minimum Basic Agreement scale for writing:  (a) a screenplay, (b) a rewrite, plus (d) a polish.   


10.2 In this last will and testament, Stevens hereby leaves his ownership in and to the Wilbur Smith Project screenplays (but not the underlying rights) to be divided evenly among his grandchildren – which to date number three.   


11. OTHER POSSIBLE LITERARY ASSETS OWNED BY STEVENS; NOT NECES-SARILY LISTED IN THE ORDER OF THEIR CREATION.   


11.1 To save confusion in the event any of his heirs run across a diskette or copy of a script written by Stevens and wonder if it has any value, Stevens has hereunder inventoried all such possible assets; together with their status.  


11.2 As of the time of the filing of this Last Will and Testament, Stevens’ potential literary assets, including rights that he no longer owns, consist of the following (hereafter sometimes the “Former Literary Works”):    


11.2 (a)    “The Saddle,” a 1-hour spec teleplay written and copyrighted by Dennis Frank Stevens in 1956 and sold in 1957 to Hal Hudson and Four Star Productions.  Plot points in the teleplay were the inspiration for the television series “The Westerner,” (1960), starring Brian Keith. Stevens no longer owns any rights to the screenplay.  


11.2 (b)    “The Adventuress,” screenplay commissioned by Warner Bros. Television in 1988, and based upon “The Man in the Brown Suit,” by Agatha

Christie.  Simultaneously, the television movie’s co-producer and distributor (Alan Shayne and CBS Television, respectively) hired another writer, Carla Jean Wagner, to write a second version of the Christie mystery.  Stevens’ version stuck fairly close to the novel. In the end, Warner Bros., Shayne and CBS elected to go with the Wagner version, which was aired on CBS in 1989. As a work for hire, Stevens no longer holds any rights to his Christie teleplay.   


11.2 (c)   “Wild Justice,” based upon the novel of the same name by Wilbur Smith.  In 1992, Stevens was commissioned to write the two part (four hour) teleplay, based upon the Smith novel.  Unbeknownst to Stevens, the British producers had hired a second teleplay to be simultaneously written; which teleplay was turned in first.  The 1993 TV miniseries was made with the second teleplay and starred Roy Scheider and Sam Wanamaker. In 1994 a feature film based upon the same novel was released, also starring Roy Scheider.  It went straight to video. As a work for hire, Stevens no longer owns any rights to this material.  


11.2 (d)     “The Thor Conspiracy,” based upon the novel, “Delta Decision,” by Wilbur Smith.  The screenplay was written by Stevens under an option agreement by RFG Associates, Inc.; which option was dropped after one year.  The underlying rights are no longer available and, as a work for hire, Stevens no longer has any interest in the screenplay.       


11.2 (e)     “The Trans Am Cross-up,” fictional story and teleplay by Dennis F. Stevens, loosely based on the 1995 footrace across America from Huntington Beach, CA to Central Park, N.Y., the screenplay of which was first copyrighted in 1995 by Stevens and the rights of which are owned outright by Stevens and filed with the Library of Congress (PAu002735971).  


11.2 (f)   Working title: “The Remake of Doomsday Flight” (1966-TV), was commissioned by Australian producer, Tom Broadbridge, who optioned the remake rights from the Rod Serling estate in 1997.  In the original William A. Graham directed drama, a bomb is planted onboard a domestic flight with an altitude-sensitive trigger which activates the bomb when the aircraft ascends above 20,000 feet and will explode when the plane descends through the altitude of 5,000 feet, unless the ransom demand is paid.  The flight diverts to and lands safely at Denver. In Stevens’ version, a counter terrorist operation swings into action when it is learned that terrorists have planted a dirty bomb aboard a flight from New Zealand to Los Angeles. In the end, Stevens’ flight lands safely in the

high altitude city of San Jose, Bolivia.   Stevens no longer owns any interest in this project; the teleplay of which is presently owned by Broadbridge.  


11.2 (g     “Behind Hospital Walls,” television movie (work for hire) commissioned by R. Douglas Collins, MD, and copyrighted in 2002.  Story deals with a murder mystery, based on the actual experiences of Dr. Collins (check Amazon. com.) while practicing medicine in Myrtle Beach, South Carolina,  Although Stevens wrote this teleplay, he holds no rights therein.  


11.2 (h)     “Tokyo Fly-by,” an unaired television movie (work for hire) commissioned by CAPT Dale Cox, USN (Ret.), story is based on a true World War II incident.  Although Stevens wrote this teleplay in 2002, he holds no rights therein.    


12. STILL OTHER FILM PROJECTS PRODUCED, WRITTEN OR DIRECTED BY DENNIS F. STEVENS:  


12.1     In addition to those projects listed herein above, Dennis F. Stevens wrote and/or directed some sixty plus TV commercials and/or business films; copies of the scripts of which the heirs may come across from time-to-time.  These include “Plastics: the World of Imagination,” which won its writer-director, Stevens, the CINE Award for 1981. It also includes the copyright to a series of TV commercials for the Baringer Winery (Napa Valley) spoofing the 1976 Judgment of Paris wine tasting competition held by Steven Spurrier whereby California wines beat the best France had to offer.   Stevens maintained ownership of copyrights to the scripts (copies of which scripts are posted on the Cinema Arts Website). Stevens hereby bequeaths the copyright to the material, and thus the concept, to his nephew Spencer Riviera.   


12.2     In September of 2000, utilizing the cooperation and assistance of the IDF/AF, in Israel Stevens directed and filmed aerial footage; together with four principal photography scenes, financed by Jacob Shapiro, for the film “Eagle in the Sky.”  Footage was meant to be used in a promotion trailer to attract investors and/or studio interest.  Louis “Lou” Lenart was the IDF coordinator and technical advisor; Louis “Duke” Goldstone was the production manager and Richard “Rick” Bell the cameraman.  John Milius was scheduled to direct the feature film version. The camera platform for the aerials was a Lear Jet, provided by Wolfe Air, of Pasadena, CA.

12.2 (a)    The principal photography scenes actually photographed involved Israeli actress Ravit Rozen (“Tinkerbell”) playing Hannah and British actor Ioan Gruffudd playing Joe Mordecai.   These scenes, including 4,800 feet of 35 mm color negative (5254) film, was intended to be used in the final film. In the feature, Keanu Reeves was scheduled to play David Morgan; Rachel Weisz was to play Debra Mordecai while Gene Hackman was to take the role of General Mordecai, the “Brig.”    


12.2 (b)    The filming of this promotional trailer was abruptly halted when the IDF went on alert following the stroll upon the Temple Mount by Arial Sharon on Thursday, September 28th, 2000.  The following day Israel cancelled its war insurance to foreign companies filming in Israel and all production was shut down, including the “Eagle in the Sky” promotional trailer.  The loss was costly and devastating and the subsequent film was never made.    


12.2 (c)      Stevens hereby bequeaths the rights, if any, to the physical material, but not any literary rights (which he doesn’t own) with respect to this paragraph 12, to his son, Tore; the film footage of which is stored with Retro Video (Pasadena).  


13. OTHER ASSETS:  


13.1 At the time of the filing of this Last Will & Testament, Stevens owns a 1991 Ford Taurus automobile (license no. 1M61371), licensed in the State of Idaho and insured by Farmers.  The condition of the automobile is “drivable.”  


13.2 In addition to the automobile, Stevens owns clothing, furniture, office supplies, computers, monitors, printers, and television sets estimated to be worth approximately $600.00 or less (sold used).  Some electronic equipment belongs to Cable One (Idaho Falls), including the Wi-Fi unit and the two digital TV tuners. They will have to be returned when the cable service is terminated.   


13.2 (a)     The assets under this paragraph shall be divided as follows:   (i) The computers, printers and monitors – to the extent she wants them, I bequeath to my daughter Melbi;  (ii) Everything else, to the extent they want it, I bequeath to my cousin Vicki Lee Grover and her husband Wayne, to distribute as either sees fit;  (iii) Unwanted items may then be sold or donated to a charitable organization such as Deseret Industries; (iv) Proceeds from any sale will go to the Stevens’ estate to be distributed as the Executor shall determine; mostly based on need.

13.2 (b)   Photographs, DVDs, hard copies of my written memoirs, etc., shall be divided among those who wish to have them – otherwise they are to be put in the dumpster.   Fern Lee Stevens’ journals and any other such memorabilia are to go to my sister Charlotte or her children – to do with as they wish.      


14. OTHER BEQUEATHS:   


14.1 My 1991 Ford Taurus shall be sold and the proceeds given to my estranged wife, MELBA R. STEVENS, with whom I have been contractually separated since May 5, 2005 – and physically separated since 01/01/2004, when I moved to Rexburg and Melba remained in Southern California.      


14.2 Anything of a financial nature, cash; the bank account balance with Washington Federal, etc. shall go to my sister Charlotte; with the exception that the balance in the checking account with U.S. Bank that I share with Vicki Grover, I hereby bequeath to my cousin Vicki Grover and/or her husband Wayne.    


14.3 Should I be fortunate enough to own any stocks or bonds at the time of my death, I leave it to the Executor as to how distribute the proceeds.  It would be my wish, however, that said funds, if any, be distributed among my sister, my daughters Melbi Lee Stevens and Erin Leigh Stevens; together with my wife, Melba, according to need and the Executor’s judgment.      


14.4 Further Paragraph 14.3, no such funds shall go to my son, Tore Donald Stevens, as he has already benefitted from my potential estate by my mother, Fern Lee Stevens, forgiving the outstanding mortgage on the family farm – which Tore was allowed by Fern to purchase at a drastically reduced price and without a down payment or credit check, and which outstanding mortgage would otherwise have been divided between my sister, Charlotte, and me.    


15. PREDECEASED:  


15.1 If a named beneficiary to this Will predeceases Stevens, the bequest to such person shall lapse and, with the exception that the Executor shall not be a beneficiary, it shall be at the discretion of the Executor to determine how any such bequeath(s) are then distributed.  


16. SITE OF BURIAL:

16.1 I desire to be buried in the Rexburg cemetery, in Madison County, Idaho, adjacent to and utilizing the same tombstone of my parents; Frank W. and Fern Lee Stevens.  The plot reserved for me was originally purchased by my uncle, John Lee for use by his sister, Fern Lee (my mother) and her family.    


16.2 I further desire that only a brief, informal graveside service be held with the attendance of only a few of those close relatives wishing to be present.   


17. FUNERAL HOME ARRANGEMENTS:  


17.1 If still in business at the time of my death I request that the Flamm Funeral Home in Rexburg will be in charge of preparing my body and that they will not be stingy with the preservative.  


17.2 I prefer to be buried wearing the Navy flight jacket bestowed on me in 1985 by then Secretary of the Navy, John F. Lehman, Jr. who declared me to be an honorary commander in the U.S. Navy for services rendered the Department of Defense as an aerial cinematographer during testing of the F-14 Tomcat; Lockheed’s Have Blue project, and the F-16 Pulse Doppler radar tests; the latter of which was done working with Duke Goldstone, Westinghouse and United Technologies.  In awarding the honor, Lehman cited my contributions as a writer and cinematographer for Lockheed, Westinghouse and United Technologies sponsored DoD/Navy films going back to 1959 and my employment with Lockheed’s Skunk Works at their facilities near Mountain View, California.  


17.3 Although I was declared an honorary commander in the U.S. Navy, I was never a member of the military and thus not entitled to any military honors.  


17.3 (a)   If possible, my burial pants shall be the pair of CNT (Certified Naval Twill) khaki slacks already in my possession and which I occasionally still wear.    


17.3 (b)   I will put my desired burial clothes in a box so marked and leave in a closet within my apartment.   


18. ALL REMAINING PROPERTY; RESIDUARY CLAUSE:  


18.1 If I do not possess or own any of the property or financial interests listed above on the date of my death, the bequest of that property shall lapse.

18.2 The terrific “O.K. Google” device in my bedroom is on loan to me from my daughter Melbi and shall be returned to her with my thanks.  


19. ARCHIVIST FOR THE JOURNALS OF DENNIS F. STEVENS: 


19.1 In 2004, while my memory was still reasonably good, I began writing an account of what to me were the highlights of my life and career.  I named the memoirs THE JOURNALS OF DENNIS F. STEVENS. Many of the journal entries were taken from diaries I kept throughout my career for the purpose of recording travel and other expenses for the purpose of justifying deductions in the event of 

an IRS audit.  The dates of these entries, therefore, are fairly accurate.  Other 

journal entries are from memory and therefore not as reliable.  


19.2 The journals are divided into numerous volumes.  There is but a single hard copy of the journal entries and it is my desire that my nephew Spencer Riviera be the temporary archivist for these journals the family might wish to keep for any length of time – it being understood that there is no reason to keep the journals on a permanent basis.   


20. ADDITIONAL PROVISIONS & REQUESTS:  


20.1 Although I’m not aware of any real property, should there be any at the time of my death, the bequeathed shall be responsible for any debts and the said debts shall not be paid by the Executor.  Otherwise, any and all debts of my estate shall first be paid from my residuary estate.  


20.2 If any beneficiary to this Will is indebted to me at the time of my death, and whether or not this indebtedness is evidenced by a Promissory Note, such beneficiary’s indebtedness is hereby forgiven.   


20.3 It’s my wish that the Executor via payments(s) to Network Solutions) keep the Cinema Arts website at cinemaarts.com operational for at least 10-years after my death.   It’s my wish that my daughter, Melbi, be the webmaster.    


20.4 In drafting his last will and testament, Dennis F. Stevens uses the 1st, and 2nd person narrative; which narratives shall be deemed as if Stevens were always speaking in the 1st person narrative.   


21. NO CONTEST CLAUSE

21.1 If any beneficiary under this will seeks to obtain in any proceeding in any court an adjudication that this will or any of its provisions is void, or seeks otherwise to void, nullify, or set aside this will or any of its provisions, then the right of that person to take any interest given to him or her by this will shall be determined as it would have been determined had such person predeceased the execution of this will without issue.   


22. SEVERABILITY AND SURVIVAL:  


22.1 If any part of this Will is declared invalid, illegal, or inoperative for any reason, it is my intent and wish that the remaining parts shall be effective and fully operative, and that any Court so interpreting this Will and any provision in it construe in favor of survival.   


23. SELF PREPARED:  


23.1 This last Will and Testament is self prepared without benefit of attorney therefore preparer Stevens prays that anyone interpreting same shall seek out the overall intent of each and every clause herein and to basically ignore errors in spelling, grammar, syntax, capitalization and punctuation.
